How to file an external review in Wyoming

In Wyoming, external review is run by the state through the Department of Insurance, which assigns your case to a licensed Independent Review Organization (IRO) that is fully independent of your insurer. The process applies to denials based on medical necessity, and you must first exhaust your plan's internal appeals. You then have up to 120 days from the final internal denial to submit a written request to your insurance carrier, which forwards it to the IRO. A modest filing fee may apply, payable to the Wyoming State Treasurer, and the rest of the cost is borne by the insurer. Standard decisions are issued within 45 days; urgent cases qualify for expedited review with a decision within 72 hours. The IRO's ruling is binding on the insurer.

Wyoming appeal questions

How do I file for external review in Wyoming after a denied claim?

First finish your insurer's internal appeal process, since Wyoming only allows external review after that is exhausted. Then submit a written external review request to your insurance carrier, which forwards it to a licensed Independent Review Organization assigned through the Wyoming Department of Insurance. The Department's Independent Review Organization (IRO) page provides the request form and instructions.

What is the deadline to request an external review in Wyoming?

You have up to 120 days from the date of your insurer's final internal denial to submit a written request for external review. Missing this window can forfeit your right to an IRO review, so it is important to act promptly once the internal appeal is exhausted. Keep a copy of the denial letter, since its date starts the clock.

Does an external review in Wyoming cost anything?

Wyoming may charge a modest filing fee per external review request, payable by check or money order to the Wyoming State Treasurer. Apart from that fee, the review itself is free to you because the insurer bears the cost of the Independent Review Organization. If you cannot afford the fee, ask the Department of Insurance about a hardship waiver or your other options.

Is the IRO decision binding, and what if my plan is self-funded?

Yes. The Independent Review Organization's decision is binding on the insurance carrier, and the reviewer weighs whether the denied service was medically necessary based on your records and the plan's terms. Note that many large Wyoming employers offer self-funded ERISA plans, which fall outside state insurance rules; in that case you would use the federal external review process administered by HHS through its contractor MAXIMUS rather than the Wyoming program.
